Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent The writ petition has been filed seeking the following relief:- "(i) To call for the records and to issue a writ, order or direction in the nature of mandamus commanding the respondent No.3 to consider and decide the stay application filed by the petitioner expditiously in a fixed time frame in the Appeal No.1653 of 2024 (Computerized Case No.C202407000001653) M/s Tapasya Const. Vs. D.M. Banda under Section 79 of the Uttar Pradesh Minor Minerals (Concession) Rules, 2021." The petitioner is aggrieved that the stay application filed alongwith Appeal No.1653 in November 2024 has not been decided till date. Under the circumstances, the petition is disposed of directing the third respondent to consider the stay application filed by the petitioner and to pass appropriate orders thereon after hearing all necessary parties preferably within a period of two weeks from the date a certified copy of this order is filed before him. Needless to say that this Court has not applied its mind to the claim of the petitioner nor as expressed any opinion thereon.
