1. Heard Mr. M.A. Sheikh, learned counsel for the
Page No.# 2/3 petitioners. Also heard Ms. G Hazarika, learned counsel for the sole respondent.
2. The present petition is filed alleging willful and deliberate violation of this court’s order dated 06.08.2024, passed in WP(C) No.3652/2024.
3. This court by the aforesaid order dated 06.08.2024,
directed the Principal Secretary to the Government of Assam, Revenue & Disaster Management Department to consider the representation of the writ petitioners therein within a period of one month from the date of the said order and a direction was also issued to file a compliance affidavit. However, no such compliance affidavit was filed.
4. Accordingly, this court passed an order on 16.05.2025, providing that if the compliance report as required is not filed before 28.05.2025, the sole respondent shall have to remain personally present before this court. Thereafter a compliance affidavit has been filed and a speaking order dated 26.05.2025 (Annexure-1) has also been filed.
5. Mr. Sheikh, learned counsel for the petitioner, however, submits that such speaking order is not in conformity with the earlier order dated 06.08.2024 and accordingly, has filed a reply affidavit.
6. Be that as it may, as the speaking order has been passed, the present contempt petition is closed with liberty to the petitioner to assail the aforesaid speaking order dated 26.05.2025, taking all legally permissible grounds by the petitioner, including the stand
Page No.# 3/3 taken in the affidavit-in-reply filed by the petitioner.
7. With the aforesaid, the contempt petition stands closed.
