HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 18/08/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.177/2025, registered at Police Station Hindaun, District Karauli, for the offence(s) under Sections 8/21 and 8/22 of the N.D.P.S. Act.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated under Section 8/29 of the N.D.P.S. Act. It is contended that name of the petitioner does not found mention in the FIR rather the name of the other co-accused Sanjay and Amit has been mentioned. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the Police has collected the WhatsApp details of the petitioner and the other co-accused Sanjay, which indicates that the petitioner and the co-accused Sanjay from whom commercial quantity of drugs was found was in contact with the petitioner and an amount of Rs.5,000/- and Rs.30,000/- was deposited through PhonePe by the co-accused in the account maintained by her mother. It is further argued that the communication made through WhatsApp Chat between the co- accused and the petitioner indicates the involvement of the petitioner and the call detail report of the petitioner with the co- accused also indicate that they were in contact with each other from a long time, therefore, the bail application of the accused- petitioner may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case, the Police after investigation have collected ample evidence which shows that the petitioner was in contact with the other co- accused through WhatsApp and the WhatsApp chats prima facie indicates the involvement of the petitioner in the alleged offence. Further, the transactions that occurred between the petitioner and the other co-accused also validated the case of the prosecution. The principle enshrined under Section 37 of the N.D.P.S. Act is mandatory, therefore, considering the above facts and without
