The Writ Petition is filed questioning the action of the respondents in not releasing the amounts of Rs.32,64,099/- vide M Book No.81/2022-23, even after finalizing the bills payable to the petitioner in relation to the works i.e., Transportation, Supply & Distribution of Drinking water through 4000 ltr capacity water tankers with vehicle tracking system with Tractor Engine for supply of Drinking water at Various places in Chilakaluripet Municipality, From 1st ward to 38th ward, vide Agreement No.308/2022-23, dated 03.3.2023, is illegal and arbitrary. 2. Heard Sri Bathala Ramesh, learned counsel for the Petitioner and Smt.Sireesha Rani, learned Standing Counsel for the Respondent No.4-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.4 - Municipality passed on written instructions signed by the Municipal Commissioner, Chilakaluripet, which is placed on record, wherein it was stated that the execution of work by the petitioner was admitted and that the Municipal authorities have prepared the bills for payment. It is further stated that due to financial 3 priorities, the bills of the petitioner could not be cleared. It is also stated that the Municipal Authorities are processing bills for uploading in CFMS portal on priority basis one by one on availability of funds including the petitioner’s bills. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order. 5. The Writ Petition is disposed of. There shall be no order as to costs.
