KURHIMARI P.S. ULUANI, DIST. NAGAON, ASSAM, PIN-782143 VERSUS THE STATE OF ASSAM REP BY THE PP ASSAM Advocate for the Petitioner : PRASENJIT MAZUMDER, MR. S CHAUHAN,MR. P MAZUMDER,M. BORUAH Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MRS. JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 06-01-2025 Heard Mr. P. Mazumder, learned counsel for the applicant Sri Manoj Kumar Chetry, who has filed this application for modifying/altering the condition No. (iv) of the order dated 28.11.2024 in connection with AB No. 3102/2024 in paragraph No. 8. The condition was that the petitioner shall not leave the Page No.# 2/2 jurisdiction of the Court without prior permission. 2. It is further submitted that the petitioner is a Constable in the ITBP and attached to 42 BN and at present posted at Jodhpur, Rajasthan. 3. Heard Mr. P.S. Laskar, learned Additional Public Prosecutor, Assam for the respondent State. It is submitted that charge sheet has been laid against the petitioner. 4. However, I have considered the prayer that the petitioner is posted at Jodhpur, Rajasthan and as this Court has passed the order directing the petitioner not to leave the jurisdiction of the Court without prior permission, this Court is not privy to the difficult situation the petitioner will face if he has to take written permission from the Court on every date. Therefore, condition No. (iv) of the terms and conditions for granting bail passed in the order dated 28.11.2024 in connection with AB No. 3102/2024 is deleted. 5. However, the petitioner is directed to cooperate with the proceeding and to appear before the Court as and when required by the Court. 6. In terms of the above observation, this Interlocutory Application stands disposed of. JUDGE Comparing Assistant
