[2025:RJ-JP:27811] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 7569/2025 1. Akash S/o Laxminarayan @ Lachchhu, Aged About 25 Years, R/o Hazardiya, Police Station Unhail, District Jhalawar (Rajasthan) (Presently Confined In District Jail Jhalawar). 2. Gyanchand S/o Ramsingh, Aged About 45 Years, R/o Hazardiya, Police Station Unhail, District Jhalawar (Rajasthan) (Presently Confined In District Jail Jhalawar). ----Petitioners Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Rajneesh Gupta for Mr. Dinesh Kumar Garg For Respondent(s) For Complainant(s) : : Mr. Jaiprakash Tiwari, PP Mr. Shantnu Bansal, HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 24/07/2025 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.0066/2025 registered at Police Station-Unhel Nageshwar, District-Jhalawar for offences under Sections 191(2), 115(2), 126(2), 109(1) of BNS and Section 5/27 of the Arms Act. 2. Heard learned counsel for the petitioners, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He contended that for the same incident, a cross case has been registered by [2025:RJ-JP:27811] (2 of 3) [CRLMB-7569/2025] the complainant also, which is evident by para 5 of the impugned order and they have settled the dispute amicably. He further contended that there is no medical opinion on record, by which, it can be inferred that the alleged injuries are dangerous to life. It is further contended that petitioners are behind the Bar since 12.05.2025 and the trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence the bail application of the petitioners may be allowed. 4. Learned counsel for the complainant admitted the fact of compromise and stated that the petitioner and the complainant/injured have settled their dispute amicably and have entered into compromise, therefore he has no objection if the petitioners be released on bail. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the fact that compromise has arrived between the parties but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-(1) Akash S/o Laxminarayan @ Lachchhu and (2) Gyanchand S/o Ramsingh shall be released on bail on their furnishing a personal [2025:RJ-JP:27811] (3 of 3) [CRLMB-7569/2025] bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
