Neutral Citation No. - 2025:AHC:29770-DB Court No. - 40 Case :- WRIT - C No. - 5310 of 2025 Petitioner :- Rajendra Kumar Respondent :- Hindustan Petroleum Corporation Limited And Another Counsel for Petitioner :- Ashutosh Chaubey,Vikas Tiwari Counsel for Respondent :- Vaibhav Tripathi Hon'ble Shekhar B. Saraf,J. Hon'ble Vipin Chandra Dixit,J. 1. Heard learned counsel appearing on behalf of the petitioner and Sri Vaibhav Tripathi, learned counsel appearing on behalf of the respondents. 2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by an order dated November 18, 2024 whereby the Hindustan Petroleum Limited has rejected the application of the petitioner for award of retail outlet dealership to the petitioner on the ground that the land offered by the petitioner was not leased by all the four co-owners. 3. Learned counsel appearing on behalf of the petitioner submits that though the lease was not provided by all the four co-owners but no objection was provided. 4. It is to be noted that this Court in catena of judgements has held that the requirement of providing lease from all the co-owners is mandatory as per the terms and conditions of the Oil Corporation and the same cannot be bypassed by the petitioner by providing a simpliciter no objection letter. 5. In light of the same, we do not see any reason to interfere in this matter. Accordingly, the writ petition is dismissed. Order Date :- 3.3.2025 Dev/- (Vipin Chandra Dixit,J.) (Shekhar B. Saraf,J.)
