The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case).
The Court made the following ORDER: Heard the
learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the State. Considering the facts and circumstances of the case, the condition in paragraph No.6(ii) is hereby relaxed. The petitioner, henceforth, need not appear before the Station House Officer. However, the learned Assistant Public Prosecutor submits that the charge sheet is not yet filed. In view of the above, the petitioner shall make himself available to the Station House Officer/Investigating Officer, as and when required.
