The present application under Section - 528 BNSS has been preferred against order dated 30.01.2025, passed by Additional Principal Judge, Family Court, Court No.4, Ghaziabad in Case No. 230 of 2017 (Swati Vs. Sushobhit), under Section - 125 (3) Cr.P.C., Police Station - Masuri, District - Ghaziabad. 3. After arguing at some length, learned counsel for the applicant submits that due amount of arrears of maintenance is Rs. 10 lakhs but the opposite party No. 2 and 3 are claiming that there are arrears of maintenance in the tune of Rs. 11,32,208/- and thus, a direction may be made to the Family Court concerned to determine the arrears of maintenance and to allow the applicant to pay the arrears of maintenance in installments. 4. In view of aforesaid, it is directed that in case applicant moves an application through counsel before the Family Court concerned within a period of two weeks from today, raising his grievance regarding calculation of arrears of maintenance and to pay the amount of maintenance in installments, the same shall be considered and decided expeditiously in accordance with law. 5.
