The petitioner has filed the instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of FIR No.08 dated 18.01.2023 registered under Sections 498-A & 406 of IPC, 1860 at Women Police Station, Sector-5, Panchkula (Annexure P-1) and all other subsequent proceedings arising thereof on the basis of joint petition filed by the parties under Section 13-B of Hindu Marriage Act, 1955 for dissolution of marriage which was decreed by learned Principal Judge, Family Court, Panchkula vide order dated 13.12.2024. 2. Learned State counsel, on instructions from ASI Narender Kumar, submits that cancellation report has already been filed before the Trial Court on 06.07.2024. 3. In this view of the matter, learned counsel for the petitioner wishes to withdraw the present petition with liberty to pursue the cancellation report filed before the Trial Court. 4.
