The Writ Petition is filed questioning the action of the respondents in not releasing the amounts of Rs.3,59,743/- vide M Book No.139/2021-22, Rs.4,32,519/- vide M Book No.156/2021-22, Rs.3,35,086/- vide M Book No.68/2022-23, Rs.2,41,684/- vide M Book No.177/2020-21 & Rs.84,558/- vide M Book No.121/2020-21, even after finalizing the bills payable to the petitioner in relation to the works i.e., (i) Raising of CC Road D.No.21-6 to D.No.21-45 at Tavva Bapanaiah Street in 20th Ward in Chilakaluripet Municipality, vide Agreement No.15/2023-24 dated 15.4.2023, (ii) Raising of CC Road D.No.21-15 to D.No.21-26 at Tavva Bapanaiah street in 20th Ward in Chilakaluripet Municipality, vide Agreement No.14/2023-24, dated 15.4.2023, (iii) Formation of WBM road at North side of Mother Theresa Colony UHSC building 38th ward in Chilakaluripet Municipality, vide Agreement No.35/2023-24 dated 30.6.2023, (iv) Construction of damaged CC drain from Y Ravi House to Sk.Masthan Vali house at Gundaiah thota in 27th ward in 3 Chilakalauripet Municipality, vide Agreement No. 200/23-24, dated 07.10.2023 and (v) Construction of RCC culvert and CC Approach at North side of UPHC building at Mother therissa colony 38th ward in chilakaluripet municipality, vide Agreement No.105/23-24 dated 13.7.2023, is illegal and arbitrary. 2. Heard Sri Bathala Ramesh, learned counsel for the Petitioner and Smt.Sireesha Rani, learned Standing Counsel for the Respondent No.4-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.4 - Municipality passed on written instructions signed by the Municipal Commissioner, Chilakaluripet, which is placed on record, wherein it was stated that the execution of work by the petitioner was admitted and that the Municipal authorities have prepared the bills for payment. It is further stated that due to financial priorities, the bills of the petitioner could not be cleared. It is also stated that the Municipal Authorities are processing bills for uploading in CFMS portal on priority basis one by one on availability of funds including the petitioner’s bills. However, the above five work bills of the petitioner have been submitted in CFMS portal vide CFMS No.2024- 2520528, 2024-2517143, 2024-2482206, 2024-2481871 and 2024- 4 2493199 but the Government have cancelled the above bills due to financial year closing. Now we are processing the bills again for payment. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
