2. Government Pleader for Revenue for the respondents. 3. The learned counsel for the petitioner submits that aggrieved by the order passed by the appellate authority the petitioner has filed revision petition vide R.P.No.17 of 2024 before the 2nd respondent and attended the revisional proceedings whenever it was called. While so, on 30.11.2024 when the revision was taken up for hearing, the petitioner did not appear before the revisional authority/2'''' respondent herein as his son was admitted into the hospital due to severe cardiac arrest. On the said ground, the 2'''* respondent dismissed the revision petition for default filed by the petitioner. The learned counsel for the petitioner submits that without considering either grounds of revision or material filed by the petitioner and without providing any opportunity of hearing to the petitioner, erroneously, the 2"'' respondent has dismissed the revision petition vide R.P.No.17 of 2024 which is illegal. On the other hand, learned Assistant Government Pleader for Revenue appearing for the respondents submits that if the petitioner has filed any appropriate application before the 2nd respondent for restoration of the revision petition on the file of the 2^^ respondent by duly explaining the reasons for his absence on 30.11.2024 with medical evidence, the 2nd respondent would consider the same and pass appropriate orders. 5.Having regard to the submissions made by both the learned counsels and on perusal of the material on record, this Writ Petition is disposed of directing the petitioner to file an appropriate restoration petition/application respondent with all relevant documents within a period of two (02) weeks from the date of receipt of a copy of this order.
On filing of such an application, the 2 nd before the 2 nd respondent is directed to consider the same and pass appropriate orders within a period of two (2) months thereafter after providing opportunity of hearing to the petitioner as well as to other stake holders, if any.
