PUBLIC PROSECUTOR _The Court Made the FoI]owinq Order:- The Criminal Petition, under Section 482 of.the BNSS, is filed on behalf of the petitioners herein/Al and A2 to grant anticipatory bail in connection with Crime No.90 of 2025 of Ponnur Rural Poll-Ce Station, Guntur District, registered for the offences punishable under Sections 308(2) and 351(2) read with 3(5) of the BNS. During the course of investigation, Section 108 of the BNS has been added. 2. Case of the prosecution, in brief is that on o8.05.2025, the defacto complainant filed a report before the police stating that he --==±.-,-L -` <=t- `.---9 rirfe jfe- OWned One tractor and that On 23.07.2023, he had borrowed a sum of Rs.1,70,000/-from Al for agricultural purposes. Subsequently, the defacto complainant repaid an amount of Rs.75,000/- and informed Al that the remaining amount, along with applicable interest, would be settled shortly.However, despite this assurance, A1, along with A2, visited the defacto complainant and allegedly threatened him with dire consequences'. They attempted to forcibly take possession of the tractor, When the defacto complainant resisted and refused to hand over the tractor, Al and A2 allegedly used criminal force, created fear, and forcibly took the tractor away from him.Subsequent to the above incident and the lodging of the report, it is reported that the defacto complainant died by committing suicide c;n 12.05.2025. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor for the respondenvstate. It is submitted by the learned Assistant Public Prosecutor that the investigation in the present crime is at nascent stage. perused the record. 4. A perusal of the material on record goes to show that the petitioners had lent a sum of Rs. 1,70,000/-to the deceased. Thereafter, the deceasecl made a part payinent of Rs. 75,000/-. Pursuant to that, the petitioners allegedly pressurized the -deceased to repay the remaining amount. upon that, when the deceased expressing his inability to do so, it is alleged that the petitioners tried to take away the tractor belonging to him. There,is no nexus between the acts committed by the petitioners and the death of the deceased. The de.ceased filed the police report on o8.05.2025, and `JQs`-.I '-.# ----- FZ' after a lapse of four days, the deceased took the extreme Step Of committing suicide. No reasons were assigned aS tO Why he committed suicide. The reason that has been stated in the First Information Report is that only for the acts Of the Petitioners that they tried to take away the tractor belonging of the defacto complainant, the incident occurred. Except the said act, there is no other material to connect the petitioners herein to the Crime.ln View of the facts and circumstances of the case, this Court is inclined to c6nsider the request of the petitioners/Al and A2 for grant of anticipatory bail, however, on conditions. 5. Accordingly, in the event oftheirarrest in the abOVeSaid Crime, the petitioners/Al and A2shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees~|wenty five thousand only) each with two sureties each for the like sum to the satisfaction of the arresting police officials and also on condition that the petitionersshall makethemselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners sh--all appear before the Station House Officer concerned, everyday between 10.00 AM and 1.00 PM, till filing of the charge sheet. 6. Accordingly, the Criminal Petition is allowed.
