Heard Mr. B Chakraborty, learned counsel for the petitioners. Also heard Mr. A Bhattacharjee, learned standing counsel, Revenue Department appearing for respondent No.1, Ms. U Das, learned Additional Senior Government Advocate appearing for respondent Nos.2 & 3 and Mr. S Dutta, learned counsel for the Silchar Municipal Board appearing for respondent No.4. 2. The writ petitioners herein, had earlier applied for settlement of Government lands under their respective possessions. According to the petitioners, the matter was placed before the Land Advisory Committee in its meeting dated 08.10.2015 and since then, no further action has been taken for disposal of the prayer made by the petitioners. 3. When the matter is listed today, it is submitted by Mr. A Bhattacharjee, learned standing counsel, Revenue Department that Page No.# 8/9 the Revenue Department had sought for fresh proposal from the District Commissioner, Cachar as per the new check list under the Land Policy, 2019. 4. It is submitted by Ms. U Das, learned counsel that the District Commissioner, by its communication NO.CRS.16/ 2017/WP(C) No.2333/2017/41 dated 06.08.2025 has submitted the required proposal as sought for by the Revenue & Disaster Management Department. 5. In view of the aforesaid development, Mr. Chakraborty, learned counsel for the petitioners submits that as the proposal has been sent under the Land Policy, 2019, this writ petition can be disposed of by directing the respondent authorities to consider the case of the petitioners as per the Land Policy, 2019. 6. Mr. Bhattacharjee, learned counsel for the respondent had contended that, now the Revenue Department shall consider the proposal in terms of the Land Policy, 2019. 7. In view of the aforesaid consensus, the writ petition stands disposed of by directing the authorities under the Revenue & Disaster Management Department to consider the case of the petitioners for settlement of their respective lands in terms of the existing norms and policies of the Government based on the proposal submitted by the District Commissioner under its communication dated 06.08.2025. 8. Such exercise be carried out within a period of three months from the date of receipt of a certified copy of this order to be furnished by the petitioners. Page No.# 9/9 9. It is needless to say that the District Commissioner, Cachar shall render his/her necessary assistance, if necessity arises. 10. A copy of the communication dated 06.08.2025 is kept on record.
