Kesharwani, Advocate Hon’ble Shri Justice Sachin Singh Rajput Order on Board 20-05-2025 1) By way of this petition, petitioner has sought following relief(s) :- 10.1 It is therefore prayed that, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ/order/direction in nature of mandamus whereby to set aside/quash the impugned order dated 28.03.2025 issued by the Respondent Collector/Zila Mission Sanchalak, Samgra- shiksha District - Balrampur Ramanujganj (CG) as well as relieving order dated 02.04.2025 issued by the Block Education Officer Wadrafnagar District-Balrampur Ramanujganj. 10.3 That, this Hon'ble Court may kindly be pleased to direct to the Respondent Collector/Zila Mission Sanchalak, Samgra- shiksha District Balrampur Ramanujganj (CG) to remove the Respondent Anil Tiwari from BRP/BRCC and sent him to his original 3 place of posting. 10.4 That, any other relief/ reliefs which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the petitioner. 2) Learned counsel for the petitioner submits that vide order dated 28.03.2025, Collector, Balrampur-Ramanujganj has removed petitioner from the post of BRCC and posted him to his original post as a Pradhan Pathak, Block – Kusmi, District – Balrampur- Ramanujganj. He further submits that petitioner has made a representation on 23.04.2025 before the Collector, Balrampur- Ramanujganj in respect of posting of the petitioner on the post of BRCC in Block – Kusmi, but no action has been taken by the respondent authorities. He prays that a direction may be issued the authority concerned to decide the representation of the petitioner at the earliest. 3) On the other hand, learned counsel appearing on behalf of respective respondents oppose. 4) Heard. 5) Taking into consideration the limited prayer made by Mr. Dubey, this petition is hereby being disposed of directing the Collector, Balrampur-Ramanujganj to decide the pending representation so moved by the petitioner dated 23.04.2025 strictly in accordance with law and communicate the same to the petitioner, preferably within period of 60 days from the date of receipt of copy of this 4 order. 6) However, it is made clear that this Court has not expressed any opinion on the merits of the case. 7) With the aforesaid observation(s) & direction(s), instant writ petition stands disposed of. 8) Accordingly, I.A.
