5 3311..0011..22002255 Court No. 25 D.Hira WPA 7522 of 2009 With CAN 1 of 2024 Minati Sarkar Vs. State of West Bengal & Ors. Mr. Sk. Imtiaj Uddin. ... for the applicant/petitioner Mr. Satyajit Talukdar. ... for the State The application being CAN 1 of 2024 is filed by the applicant/petitioner seeking recall of this Court’s order dated September 2, 2024 and restoration of the writ petition being WPA No. 7522 of 2009 in its original file and number. It appears that the writ petition being WPA No. 7522 of 2009 was dismissed for default by the Court, by dint of the said order dated September 2, 2024. The applicant/petitioner has pleaded the grounds of his innocence and bona fide in the said application whereas the reason for the applicant, not being represented before the Court on the relevant date has been attributed to the inadvertence, though bona fide of the learned conducting advocate. In view of the grounds shown in the said application and finding those to be substantive and sufficient, the Court finds it proper to allow the present application by recalling the order of the Court dated September 2, 2024 in WPA No. 7522 of 2009. 2 Therefore, let the writ petition as above be restored in its original file and number. CAN 1 of 2024 is disposed of. Let the writ petition being WPA No. 7522 of 2009 be listed under the heading “’Old Hearing Matters” immediately. (Rai Chattopadhyay, J.)
