1.PUBLIC PROSECUTOR The Court made the following Order= This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.02 of 2025 of Cyber crime police station, Manga'agiri, registered for the OffenCeS Punishable under sections 67 and 67-A of Information Technology and Sections 61, 111(1)ofBNS.
2. Case of the Prosecution, in brief, iS that the accused Persons are providing illegal adult content to xhamster website through some banned vRLs in India for remuneratiOn and Payments Were Processed by zanmai Labs, Technius Limited and Sexual COntent Was mOnetiZed with funds routed through crypto currency transactions.
3. Heard learned COunSel for the petitioner and learned Assistant public prosecutor for the respondent/state. Perused the record.

Learned counsel for the petitioner submitted that except the offence under section 111 (1) of BNS, a" other offences alleged against the petI-tiOner are punishable with imprisonment of less than seven years. According to the learned counsel for the petitioner, the offence under Section 111 (1 ) of BNS would not attract to the present facts of the case. He further submits that th'e petitioner herein was arrested on 29.04.2025 and since then he has been languishing in jail. He further submitted that it is not the case of the prosecution that charge sheet is filed agai.nst the petitioner for similar offence in Court of law in the Preceding 10 years. ln support of his contention, learned counsel for-the petitioner has placed reliance on the order passed by this court in Pesala Sivashankar Reddy Vs. 5. On the other hand, learned Assistant Public Prosecutor opposed to grant bail to the petitioner herein and submits that no antecedents have been reported against the petitioner herein.
6. On hearing learned counsel on both sides and on perusal of the materlal on record, thls court vleWS that there IS COnSIderable forgJgiv
contentions made by the learned counsel for the petitioner and I't iS for the concerned Court, after filing of charge sheet to go into the questl'on regarding the applicability of Section 111'(1) of BNS to the facts of the present case. I 2024 SCC Online AP 5422
7. ln view of the aforesaid facts and circumstances Of the Case and considering the nature of accusations and remand period of the petitioner] any further detention of the petitioner is no longer required and therefore, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner herein/Al shall be released on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned VI Additional Junior Civil Judge, Guntur. (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 01.00 p.m., for a period of two (2) months. The petitioner shall cooperate for investigation.
8. Accordingly, the Criminal Petition is allowed.
