Raghunandan Rao) ORDER: The petitioner is a handball player who had participated at the District level, State level and National level in the said sports. She applied for the post of Process Server, in the recruitment process, initiated by respondent No.3. She has now approached this Court with the complaint that respondent No.5 has been recruited for the post of Process Server, though he is far below the petitioner, in terms of sports certification. Respondent Nos.2 to 5 have filed their respective counter 2. affidavits. The case of respondent No.3 is that the relative ranking of sports persons, is obtained from respondent No.4, which is the apex sports body in the state. Respondent No.3 took the stand that respondent No.5 was recruited on the basis of the recommendation of respondent No.4. 3. ! The respondent No.4 contends that the petitioner is seeking reservation under the sports category, on the basis of a participation certificate, issued by the Handball Federation of India, which is not recognized by the Ministry of Sports and Youth Affairs and as such no ranking could be given to the petitioner. 4. The National Sports Development Code of India, 2011, at Para-3.6(7) stipulates as follows: 5. “7. Participation in national and international events organized by NSFs that are not recognized by Government of India in the Ministry of Youth Affairs and Sports shall not be considered for appointment to Government jobs under sports quota.(Ref: DOPTs orders).” f 6. In view of the stipulation, the contention of respondent No.4 would have to be accepted, as it is the case of the petitioner that the Handball Federation of India was recognized by the Indian Olympic Association and the Ministry of Sports and Youth Affairs, Government of India, had not given any such recognization. In the aforesaid circumstances, nothing further survives in the writ petition and is liable to dismissed. 7. 8. Accordingly, the Writ Petition is dismissed.
