ORDER:
ORDER:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/Al to A3 to grant anticipatory bail in connection with crime No.65 of 2025 of Medikonduru Police Sta`tion, Guntur District, registered for the offences punishable under Sections 118(1),115(2), 351(2) r/w 3(5) of BNS.'Subs'equently, Section of law was altered adding Section 108 BNS. 2. Case of the prosecution in briefisthat{he deceased Shaik lsmail was resident of perecherla Village of Medikonduru Mandal and he has two daughters and .there are family disputes between the deceased and his wife. ln this connection, on ll.04.2025 at about 22.00 hours, the accused went to the house of the deceased and while the deceas`ed was talking with them, the accused grew wild, abused the deceased in filthy language and beat on his abdomen with sticks and When the deceased fell on ground, A2 and A3 beat him with hands and legs. The deceased brother Kaleshavali interfered and pacified the issue. Again on 14.04.2025 at 1.30 hours, Al and his' friends went to the deceased house and beat him. on 15.04.2025 at about 12.30 noon, due to the I acts and behavior of the accusec!, the deceased got depression and consumed pesticide poison. Immediately the injured/deceased was
shifted to the Government General Hospital, Guntur in a private vehicle and admitted in the hospital. 3. Heard. Perused the record. 4. On perusal of the material on record, it appears that there were disputes between the accused and the deceased. ln connection with those disputes, it is alleged that on the date of the incident, the Petitioners and Others beat the deceased. Subsequently, the deceased is said to have committed suicide on' 15.04.2025 at 12:30 noon. 5. ln orderto attract the offence under section 108 of the BNS, all the essential ingredients of Section 45 BNS has to be made out. There should be instigation or intention to abet the commission of suicide. However, a perusal of the material on record reveals that, except the allegation that the deceased was beaten by the accused, there are no other specific allegations connecting the accusecl to the alleged offence
6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to consider request of petitioners for grant of anticipatory bail. 7.
Accordingly, in the event of their arrest, petitioners herein/Al to A3 shall be released on bail on each,of them executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) each, with two
i 4 sureties each for the like sum each to the satisfaction of the arresting police officials. The petitioners Shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. \ \ The petitioners Shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday, between 10.00 am and o1.00 pm, till filing of the charge Sheet. It is made Clear that the Petitioners Shall scrupulously comply With the above conditions and breach of any of the above conditions will be viewed seriously and prosecution is at liberty to move an application for cancellation of the bail. 8.
