1 D/L68 06.05.2025 Rohit ct.no.35 WPA 9256 of 2025 Soham Dutta Versus The State of West Bengal & Ors. Mr. Joyak Kumar Gupta Mr. Sutanu Chakrabarti …for the Petitioner Mr. Suman Ghosh Mr. Sankha Prasad Roy … for the State Mr. Subhasish Pyne Mr. B. Sadhu Ms. Sagnika Banerjee …for the Respondent Nos. 5,6&7 Petitioner is aggrieved by the fact that in spite of information being furnished in respect of the petitioner being defrauded of Rs.1,10,000/- and an alleged loan being disbursed to the tune of Rs.3,50,000/-, being informed to the New Town Police Station no effective steps have been taken. Subsequently New Town PS Case No. 81/25 dated 13.04.2025 has been registered for investigation under the relevant provisions. State has submitted a report. Report reflects that the current status of the defrauded amount was transferred to the merchant gateway “PayU”. The Investigating Officer has taken steps. However, having 2 regard to the complexity in the investigation I am of the view that the investigation of the case be transferred to Cyber Crime Police Station, Bidhannagar Police Commissionerate so that the same may be effectively investigated by the concerned police station. Accordingly, the Investigating Officer of New Town Police Station is directed to transmit the records of the case and hand over the Case Diary to the new Investigating Officer of Cyber Crime Police Station, Bidhannagar Police Commissionerate. With the aforesaid observations WPA No. 9256 of 2025 stands disposed of. Report so submitted be kept with the record. A copy of the report be handed over to the learned Advocate appearing for the petitioner. All parties shall act on the Server Copy of this order duly downloaded from the Official Website of this Court. (Tirthankar Ghosh, J.)
