HON'BLE MR. JUSTICE GANESH RAM MEENA (V. J.) Order 20/06/2025 1. This bail application has been filed by the accused-petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.141/2023, registered with the Police Station Principal Reserve Center, Anti-Corruption Bureau, Jaipur for offences under Section 7 of Prevention of Corruption Act, 1979. 2. Learned counsel for the petitioner has submitted that the trap proceedings could not succeed against the accused-petitioner and he is in custody since 30.05.2025 and after conclusion of the investigation, charge sheet has already been submitted in the matter. Learned counsel also submits that the trial of the case will take considerable time and the accused-petitioner is a simply a constable who does not have any authority to settle any criminal case, therefore, he may be enlarged on bail. [2025:RJ-JP:23384] (2 of 3) [CRLMB-7546/2025] 3. Learned Public Prosecutor has vehemently opposed the bail application and submits that prosecution sanction has already been accorded so as to prosecute the accused-petitioner on the basis of evidence concluded during investigation. 4. Heard. 5. Considered the submissions made at bar and also perused the challan paper. 6. On perusal of the challan paper, it is revealed that the allegation as has been levelled against the accused-petitioner, who is a constable, is of demanding some money to settle a criminal case. 7. Having regard to the submissions made by learned counsel for the accused-petitioner and taking into consideration the allegations as levelled against him and more particularly the fact that the accused-petitioner is simply a constable who may not have any authority to settle a criminal dispute as has been alleged against him and further the fact that he is in custody since 30.05.2025, this Court without expressing any opinion on merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 8. Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is [2025:RJ-JP:23384] (3 of 3) [CRLMB-7546/2025] transferred, on all subsequent dates of hearing and as and when called upon to do so.
