1 HN, J Crl.P.No.6267_2025 APHC010304092025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3457] WEDNESDAY,THE TWENTY FIFTH DAY OF JUNE TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE HARINATH.N CRIMINAL PETITION NO: 6267/2025 Between: Bhavanam Jagadeeswara Reddy ...PETITIONER/ACCUSED AND State Of Andhra Pradesh and Others ...RESPONDENT/COMPLAINANT(S) Counsel for the Petitioner/accused: 1. KOTI REDDY IDAMAKANTI Counsel for the Respondent/complainant(S): 1. PUBLIC PROSECUTOR 2 HN, J Crl.P.No.6267_2025 The Court made the following Order: 1. The petitioner is aggrieved by the order passed in Crl.M.P.No.18 of 2024 in M.C.No.38 of 2023, on the file of the Additional Junior Judge, Addanki, whereby the petitioner sought to reject M.C.No.38 of 2023 on the ground of lack of territorial jurisdiction. The 1st respondent had filed a maintenance case against the petitioner seeking maintenance for herself and her two minor children. 2. The learned counsel for the petitioner submits that both the petitioner and the respondents are residing in Hyderabad, and the 1st respondent is staying with the children. The petitioner is also residing in Hyderabad. It is submitted that the Additional Judicial Magistrate of First Class, Addanki, was invoked by showing the address of the 1strespondent’s father, projecting that she was residing with her father under his care. 3. The learned Judicial Magistrate considered the petition on merits and dismissed it on the ground that the 1st respondent resided from May 2023 at the house of her father, and the same was also evidenced by a notice sent by the petitioner/respondent. It is also observed by the learned Judicial Magistrate that in maintenance petitions under Section 125 of Cr.P.C., when the judicial forum seeks to ensure social justice and prefers to protect the interest of needy and dependent persons such as women and children, the Court would have jurisdiction if the petitioners are residing within the territorial limits of the Court. Insofar 3 HN, J Crl.P.No.6267_2025 as the present petition is concerned, the learned Judge has held that the Court would have jurisdiction as the petitioner was residing at her father’s house at the time of filing of the petition. 4. Perused the record. 5. This Court is not inclined to interfere with the order passed by the Additional Junior Judge, Addanki, in Crl.M.P.No.18 of 2024 in M.C.No.38 of 2023, as it is a well considered and well reasoned order. 6. Accordingly, this criminal petition is dismissed. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N Date: 25.06.2025 NKA 4 HN, J Crl.P.No.6267_2025 264 HONOURABLE SRI JUSTICE HARINATH.N Criminal Petition No.6267 of 2025 Date: 25.06.2025 NKA
