Also heard Mr. R.R.Kaushik, learned Additional Public Prosecutor for the respondent No.1, State of Assam. This is an application under Section 389 CrPC praying for suspension of the sentence and for bail of the applicant. The applicant was imposed sentence to undergo one and half of the imprisonment for life on 20.01.2020 by the learned Addl.Sessions Judge, Udalguri in connection with Special (POCSO) Case No.04/2019. I have gone through the impugned judgment as well as the evidence available on record. I have given my anxious consideration to the submissions made by the learned Amicus Curiae as well as the learned counsel for the applicant. The prayer is allowed. The sentence imposed upon the applicant by the learned Addl.Sesisons Judge, Udalguri in Special (Pocso) Case No. 04/2019 shall remain suspended till disposal of the connected criminal appeal. Accordingly, the applicant, Abdul Matin shall be released on furnishing bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Page No.# 3/3 Additional Sessions Judge, Udalguri.
