[2025:RJ-JP:32144] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No.7607/2025 Dipendra Singh @ Deepu S/o Kishan Singh, Aged About 25 Years, R/o Village Singla, Police Station Rupangarh, District Ajmer. (At Present Confined In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Jitendra Singh Shekhawat, Adv. For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 18/08/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.384/2024, registered at Police Station Kalwar, District Jaipur (West), for the offence(s) under Sections 189(2), 115(2), 126(2), 333, 303(2), 304(2) and 307 of BNS. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated under Sections 189(2), 115(2), 126(2), 333, 303(2), 304(2), 307 and 310(2) of BNS. It is contended that the other similarly placed co-accused namely- Manish and Balmukund have already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 01.08.2025 and co-accused namely Danveer Singh and Khushiram bails have also been accepted by the learned trial Court vide order dated [2025:RJ-JP:32144] (2 of 3) [CRLMB-7607/2025] 20.09.2024 and 11.08.2025 respectively. The case of the petitioner is akin to the other co-accused who have already been enlarged on bail. It is further contended that the accused- petitioner is in custody since 16.05.2025, charge-sheet has already been produced before the concerned Court and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the presence of the petitioner at the place of occurrence was validated from the call details collected by the Investigating Agency. The Investigating Agency after thorough investigation has charge-sheeted the accused-petitioner in the alleged crime. The accused-petitioner is a habitual offender and against him 9 cases were registered for various offences, therefore, considering the gravity of offence and criminal nature of the petitioner, the bail application may be dismissed. 4. Heard and perused the material available on the record. 5. The other similarly placed co-accused Manish and Balmukund have already been enlarged on bail by the Co-ordinate Bench of this Court and the co-accused Danveer Singh and Khushiram have also been enlarged on bail by the learned trial Court, therefore, considering the above facts, without commenting anything on the merits of the case, this Court deems it proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Dipendra Singh @ Deepu S/o Kishan Singh, in connection with [2025:RJ-JP:32144] (3 of 3) [CRLMB-7607/2025] FIR No.384/2024, registered at Police Station Kalwar, District Jaipur (West), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so. 7. The accused-petitioner is also directed to mark his presence on 25th of every month before the concerned Police Station till conclusion of the trial. The SHO of the concerned Police Station is directed to maintain a regular register marking the presence of the accused petitioner and shall send the presence report of the accused petitioner on the same day to the concerned trial Court every month without any delay. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
