Raghunandan Rao) The petitioner, who had been appointed as an Attender on 26.11.1982, is presently working as Senior Superintendent in the Court of the I Additional District & Sessions Judge, Nellore. He has approached this Court with the grievance that he was not being promoted to the post of Chief Administrative Officer, even though he is otherwise eligible. He has set out the details of his promotions from Attender to Senior Superintendent and also the instances where he was considered for promotion to the post of Chief Administrative Officer. He contends that though he was considered for promotion on two earlier occasions, he was not promoted to the post of Chief Administrative Officer, on the ground that his Law Degree had been obtained without obtaining permission of the High Court of Andhra Pradesh, and that such Law Degree cannot be recognized until it is ratified by the High Court. 2. The petitioner would contend that he would not be eligible for being promoted to the post of Chief Administrative Officer until his Law Degree is ratified, and he would further contend that the delay in such ratification cannot result in non-consideration of rtis candidature for the post of Chief Administrative Officer and such delay cannot take away his valuable right to be promoted to such post at the earliest. i 4 RRRJ. &JS.J W.P.No.l55l7of2025 Sri M.S.R. Chandra Murthy, learned counsel appearing for the 3. petitioner, would also contend that the petitioner is due to retire in two days i.e., on 31.07.2025. He would also submit that there is a vacancy available in the post of Chief Administrative Officer, to which he can be temporarily selected, pending ratification by the High Court. This is disputed by the learned Standing Counsel. Sri G. Vivekanand, learned Standing Counsel appearing for 4. tt^ High Court, would submit that the application of the petitioner for ratification of the acquisition of Law Degree has been processed and communications were addressed to the University and the College where he is said to have pursued his Law Degree. The learned counsel would further submit that the College has replied stating that the petitioner had completed his Law Degree by 1995, and that the same would be placed before the appropriate authority He would submit that till such ratification is for ratification. completed, it could not be permissible to promote the petitioner to ttfe post of Chief Administrative Officer.
