ORDER: The Writ Petition is filed to declare the action of the 3'^'^ respondent-The Sub-Registrar, Tirupati, in not recording the refusal
order and returning the sale deed document dated 02.04.2024 bearing P.No.2/2024, despite repeated requests, as arbitrary, illegal and unjust and consequently to direct the respondents to pass the refusal order and return the sale deed to the petitioner.

Learned Assistant Government Pleader has furnished the proceedings dated 30.06.2025 addressed by the Joint Sub Registrar-I, Tirupati Urban, to learned Government Pleader, Registration & Stamps, High Court of Building, Amaravati, duly submitting that a Suit is filed by Sri Bandi Sambasiva Rao against the petitioner herein. The Principal Civil Judge (Junior Division) cum Judicial Magistrate of First Class, Tirupati, passed an order in I.A. No.41 of 2024 in O.S. No.74 of 2024 on 03.02.2025 restraining the respondents from alienating the subject property, therefore the Sub-Registrar is unable to register the document, submitted by the Writ Petitioner.

Learned counsel for the petitioner would submit that the respondent-Sub-Registrar has failed to take prompt steps or to take decision either register or reject the document submitted for registration. As a result of this inaction, the petitioner has been left unaware of the status of his application, thereby depriving his opportunity, viz., legal position to take legal remedies or pursuing recourse to law. Therefore, the 3'^^ respondent is directed to return the document to the petitioner herein with appropriate endorsement.

5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, interlocutory applications, if any pending shall stand closed.
