Gayan, learned Dy. SGI for the respondent No.1, Mr. S. Bhuyan, learned standing counsel for the Higher Education Department appearing for respondent Nos.2 & 3 and Mr. M.P. Sarma, learned counsel for the respondent No.4. Mr. N.H. Barbhuiya, learned counsel for the petitioner, after arguing the matter at some length submits that he may be allowed to withdraw the writ petition with liberty to approach the respondent No.4 i.e. the Principal of Rangia College for his grievances, for payment of the balance amount of Rs.12,49,000/- (Rupees twelve lakh forty nine thousand) only, on account of the work i.e. the construction of class room at first floor at the Digital Class Room of the college. Having considered the above submissions of learned counsel for the parties and also on the perusal of the affidavit filed by the respondent No.4, this Court finds that the claim of the petitioner for payment of Rs.12,49,000/- (Rupees twelve lakh forty nine thousand) only, for construction of class room at first floor at the Digital Class Room of the Rangia College, out of the estimated amount of Rs.86,49,000/- (Rupees eighty sux lakh forty nine thousand) only, appears to be disputed and as agreed to by the learned counsel for the parties, this writ Page No.# 3/3 petition stands closed on withdrawal with the liberty granted to the petitioner to approach the respondent No.4 i.e. the Principal of Rangia College, in view of the fact that the Principal is ready to pay the said balance amount, provided that the petitioner completes the work.
