1. Petitioners seek a direction to the respondents to acquire their houses/structures, which are coming within the scope of the construction of Rattle Hydro Electric Project, and pay compensation to them in accordance with law.
2. Petitioners are the permanent residents of small villages, namely Kandani, Bhandera, Salana, Agral and Dugga in District Kishtwar. These villages are located in Drabshala-Kandni area along the river Chenab, which flows through the districts of Kishtwar, Doda, Ramban, Reasi and Jammu. It is submitted that the respondents are setting up the power project namely Rattle Hydro Electric Project, with an installed capacity of 850 MW, on the Chenab river at Village Drabshala, Kishtwar. This project is being implemented by Rattle Hydro Electric Power Corporation Ltd., a Joint Venture Company set up by NHPC Ltd.

The contention of the petitioners is that their houses/structures are falling within the proposed project area and the petitioners along with other habitants are going to be dislocated from the area. The petitioners, thus, approached the revenue authorities for the survey of the affected area and preparation of documents for acquisition of the land for compensation so that they may be able to rehabilitate themselves. It is submitted that though their structures fall within the project area, however, the same has not been surveyed till date nor any acquisition proceedings have been initiated till date.

Learned counsel for the petitioners submits that they have already approached the respondents by filing the representation and would be satisfied if this petition is disposed of with the direction to the respondent-Deputy Commissioner, Kishtwar to consider and decide their representation in accordance with law.
5. In view of the aforesaid submission, this petition is disposed of at this stage itself with liberty to the petitioners to approach the Deputy Commissioner, Kishtwar, with the representation, within a period of two weeks from today. In case, the representation is filed, the Deputy Commissioner, Kishtwar, shall accord consideration to the same within a period of six weeks.
