BHOOMA MAHARSHI REDDY Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the following: ORDER:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioner herein/Al to grant anticipatory bail in connection with crime No.31 of 2025 of Prohibition & Excise Station, Buchireddypalem, registered for the offences punishable under sections 7 r/w 8 (b) (i) of the A.P. Prohibition Act 1995. 2. Case. of the prosecution is that on 23.04.2025 at about 9.00 a.m., as per the instructions of Assistant Commissioner, the Prohibition and Excise Enforcement Wing, Nellore, the Inspector, along with his staff, proceeded for raids and reached bus stand of TadakalurLl village of Dagadarthi Mandal at about 4.30 p.m., and noticed a male person I-gr Lii=L= +- having one white colour plastic bag and on seeing them he` dropped the bag and ran away. Then, they tried to stop the saI-d Person but in Vain. As VRO and VRA were not available and no one came forward to act as mediator, the Inspector of police verified the bag and found 12 nip bottles of Celebretys Choice brandy. He drew one bottle for sample and seI'Zed the Property under cover of special report and reached to p&E Station, Buchireddypalem and handed over the case papers and property to the station for further course c,f action. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that no contraband is seized from the possession of the accused and based on the confession made by the persons working near the scene of offence, the petitioner herein has been arraigned as accused in the present crime. Learned Additional Public Prosecutor submitted that most of the investigation has been completed. 5. In view of the aforesaid facts and cI-rCumStanCeS Of the Case, this Court is inclined to grant anticipatory bail to the petitioner herein on the following conditions. I i) In the event of arrest of the petitioner in the aforesaid crime, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.1.0,000/- (Rupees Ten Thousand only) with two s'ureties of the like sum each to the satisfaction of the concemed Arresting Officer. ii) Petitioner shall cooperate with the investigation and he shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or Promise tO any Person acquainted With the facts Of the Case SO aS tO dissuade him from disclosing such facts to the court or to any police officer. u- \/ Jl r----- iii) Petitioner shall appear before the station House Officer concerned once in a week i.e. on every Sunday, between 10.00 AM and 1.00 PM till filing of the charge sheet. 6.
