Heard learned counsels for the parties. 2. The instant writ application has been preferred by the petitioner praying therein for the following reliefs: For setting aside the order issued by Memo No.1432 dated 29.06.2012; whereby and where under the Respondent No. 3 has been pleased to deny promotion to the petitioner to the post of Sub - Divisional Audit Officer and further direct the respondents to take further action in view of the letter bearing no. 936 dated 27.04.2012 whereby and where under show-cause notice have been issued to the Sub Divisional Officers stating therein that the promotion granted to them by the order of the Registrar, Co-operative Societies, State of Bihar vide Memo No. 6969 dated 27.12.2007 with effect from 01.01.1996 was illegal and beyond the jurisdiction. Further, for quashing the operation of Memo No. 1634 dated 05.07.2013 issued under the signature of Principal Secretary, Department of Co-operation, Government of Jharkhand, Ranchi; whereby and where under the department has decided to relax the requirement of passing the departmental examination which is otherwise mandatory to the grant of promotion to the post of Sub Divisional Audit Officer and has further decided to confirm the promotion granted by the State of Bihar to 8 persons whose name figures at paragraph 4 of the Memo No. 1634 dated 05.07.2013. 3. After some argument, learned counsel for the petitioner 2025:JHHC:22933 2 submits that the petitioner has been granted promotion after a long delay which is evident from the counter affidavit; as such, the petitioner may be granted liberty to approach the concerned respondent, if so advised, for retrospective date of promotion. 4. Learned counsel for the respondents submits that the instant writ application has already become infructuous in view of the fact that the prayer made in this writ application has already been implemented. 5. Having regard to the aforesaid facts and circumstances, the instant writ application stands disposed of with the liberty to the petitioner as prayed for. Pending I.A., if any, also stands closed.
