Neutral Citation No. - 2025:AHC:40390-DB Court No. - 29 Case :- WRIT - C No. - 8120 of 2025 Petitioner :- Kamlesh Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Vishwa Nath Mishra Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner has prayed for issuance of Indian citizenship to Smt. Jami Baie wife of late Amir Chand resident of C-116, Sanjay Colony, Bhati Nagar, New Delhi. Learned Standing Counsel has objected to the maintainability of the writ on the ground that petitioner has no locus to institute the present petition inasmuch as merely being a relative of the person concerned he gets no rights to apply for citizenship of the person concerned. Grant of citizenship is a matter to be regulated by the provisions of the Citizenship Act, 1955. Such consideration can be at the instance of the person concerned who is desirous of seeking citizenship. A third person will have no locus to intervene particularly when it is not shown that there is handicap for the concerned person to apply for such certificate. Since petitioner is not found to have any locus to intervene in the matter, we dismiss this writ petition, at his instance.
