COMMON ORDER
These Writ Petitions have been filed questioning the action of the respondent Banks in not returning the original title deeds deposited with the banks for obtaining loans by creation of mortgage even after completely discharging the loan amount. 2. Heard Sri Dammalapati Srinivas, learned senior counsel, representing the learned counsel for the petitioners, Sri M.Ravi Kumar, learned Standing counsel for respondent banks and Sri P.S.P.Suresh Kumar, learned Special Public Prosecutor for Central Bureau of Investigation. 3.
Sri Dammalapati Srinivas, learned senior counsel, while reiterating the contents of the writ affidavits would contend that the petitioners obtained loans by mortgaging their immovable property by way of deposit of their original title deeds and even after the loan amount was discharged and loan accounts were closed the respondent bank did neither returned the original title deeds nor released the mortgages by executing deed of release of mortgage on the ground that the original title documents were seized by the Central Bureau of Investigation in connection with crime. He would further contend that the petitioners are no way connected with the crime and it is the duty and responsibility of the respondent bank to take steps for getting back the original title deeds by initiating appropriate proceedings before the

competent Forum where the documents are lying and return them to the petitioners. Accordingly, prayed to allow the writ petitions. 4. Sri M.Ravi Kumar, learned Standing Counsel for respondent bank, submitted that the respondent bank is ready and willing to initiate appropriate proceedings for getting back the original title deeds with the assistance of the parties and in fact the respondent bank had filed application for release of documents relating to some customer and the concerned Criminal Court allowed the said petition and ordered for release of the document. 5. On the other hand Sri P.S.P.Suresh Kumar, learned Special Public Prosecutor for Central Bureau of Investigation, submitted that some of the petitioners have some role in the crime. 6. At this juncture, learned Senior Counsel prayed this Court to dispose of the writ petitions by recording the contentions advanced by the learned Standing Counsel for the respondent bank with a direction to the respondent bank for filing appropriate applications before the concerned Court for release of the documents and the petitioners would cooperate with the bank for initiation and prosecution of the said applications. 7.
Taking into consideration the submissions made by learned counsel for the parties, this Court, without going into merits or demerits of the matter

as to whether any of the petitioners have any connection with the crime, is inclined to dispose of the writ petitions, directing the respondent bank to take steps by filing appropriate applications/petitions before the concerned Court for release of the original title deeds with a period of two (02) weeks from the date of receipt of copy of this order. On such, the concerned court shall dispose of the application on merits in accordance with law as expeditiously as possible. 8. Accordingly, the writ petitions are disposed of.
