R Ali, learned counsel for the petitioner and Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State. 2) Apprehending his arrest, the petitioner, namely, Mustafa Hussain, son of Abdul Mutalib, resident of village-Gohalibhanga, Police Station-Gingia, District-Biswanath has filed this application under Section 482 BNSS, 2023 praying for his pre-arrest bail in Gingia Police Station Case No. 80/2024 registered under Section 376 of the IPC read with Section 6 of the POCSO Act, 2012. 3) By order dated 09.12.2024, the Court called for the relevant case diary pertaining to Gingia P.S. Case No. 80/2024, fixing the matter today. 4) During the deliberation of the matter, Mr. K K Parashar, learned Additional Public Prosecutor, Assam, on instruction, submitted that police after investigation submitted charge- sheet in said Gingia P.S. Case No. 80/2024 on 30.11.2024 vide charge-sheet No. 63/2024, before filing of this pre-arrest bail application of the petitioner. 5) In view of the above, the petitioner may approach the appropriate forum for his regular bail in said Gingia P.S. Case No. 80/2024, which has now been registered as Special (POCSO) Case No.94/2024 and presently pending before the Court of learned Special Judge (POCSO), Biswanath Chariali, Biswanath. 6) With the above observation and direction, this pre-arrest bail application stands closed.
