Petitioner's claim for re-issuance of passport has not been accorded consideration by the Regional Passport Officer on account of which the petitioner has approached this Court. 2. It is asserted that in Sessions Trial No. 294 of 2009 arising out of Case Crime No. 137 of 2000 u/s 452, 323/34, 504, 506, 336 and 302/34 I.P.C., P.S.- Tanda, District- Rampur, the petitioner has already been acquitted while in Case Crime No. 231 of 1999, a final report has been submitted. In one of the cases i.e. Case Crime No. 310 of 2015, the proceedings are already stayed by this Court. It is, therefore, submitted that there is no material before the authorities not to renew the petitioner's passport. 3. In the facts of the case, we permit the petitioner to place all such facts as are highlighted above to the notice of the concerned Regional Passport Officer along with certified copy of such orders. 4. So far as Case Crime No. 310 of 2015 is concerned, we permit the petitioner to approach the concerned court where the aforesaid case is pending for grant of no objection certificate by the court concerned so that the passport authorities take a fresh decision in the matter relating to renewal of the petitioner's passport. Petitioner, therefore, is at liberty to approach the concerned court which shall act in terms of the law laid down in Pawan Kumar Rajbhar (supra) and based upon its decision, the passport authorities would do the needful by passing appropriate orders within a further period of two months, thereafter. 5. Accordingly, the present writ petition is disposed of.
