The Writ Petition is filed questioning the action of the respondents in not releasing the amounts of Rs.4,59,496/- vide M Book No.134/2020-21, Rs.4,45,101/- vide M Book No.147/2020-21 & Rs.3,39,226/- vide M Book No.141/2022-23, even after finalizing the bills payable to the petitioner in relation to the works i.e., (i) Supply and delivery of sluice valves at Interconnection Zoning system at (Zone-3) Vasavi nagar Reservoir Area) in Chilakaluripet Muncipality, vide Agreement No.258/2023-24, dated 02.12.2023, (ii) Repairs of 100HP Capacity submerisible motor at NEW SS Tank in Chilakaluripet Municipality, vide Agreement No.330/2022-23 dated 31.03.2023 & (iii) Supply and Delivery arrangements for conducting YSR Aasara Programme by the Hon’ble Minister for Health, Family Welfare & Medical Education Smt.Vidadala Rajini Garu at Nannapaneni Venkata Ratnam Convention Hall in Chilakaluripet Municipality, vide Agreement No.325B/2022-23, dated 21.3.2023, is illegal and arbitrary. 3 2. Heard Sri Bathala Ramesh, learned counsel for the Petitioner and Smt.Sireesha Rani, learned Standing Counsel for the Respondent No.4-Municipality. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.4 - Municipality passed on written instructions signed by the Municipal Commissioner, Chilakaluripet, which is placed on record, wherein it was stated that the execution of work by the petitioner was admitted and that the Municipal authorities have prepared the bills for payment. It is further stated that due to financial priorities, the bills of the petitioner could not be cleared. It is also stated that the Municipal Authorities are processing bills for uploading in CFMS portal on priority basis one by one on availability of funds including the petitioner’s bills. 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the Writ Petitioner within a period of four (04) months from the date of receipt of the copy of this order. 4 There shall be no order as to costs.
