The petitioner is seeking quashment of C.C.No.346 of 2017 on the file of the First Additional Judicial Magistrate of First Class, Kadapa. It is submitted that the petitioner is residing in the UK and that during his absence for trial, non-bailable warrant was issued against him. It is submitted that the case has been pending since the year 2017, and the learned Magistrate had, vide docket proceedings dated 21.10.2019, forwarded the entire file to the Principal District Judge, Kadapa, as a Long Pending Case. 2. It is submitted that the petitioner was not served with any notice before the case was categorized as a long-pending case. The non-bailable warrant is currently pending against the petitioner. The same ought to be recalled in accordance with the procedure prescribed under the Cr.P.C. circumstances, the petitioner shall have the liberty to file a petition before the trial Court seeking recall of the warrant.
