[2025:RJ-JP:23220] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Misc. Suspension of Sentence Application No. 1157/2025 In S.B. Criminal Appeal (Sb) No. 1551/2025 Sitaram Alias Lala S/o Nahar Singh, Aged About 28 Years, Ro Dorawali Ps Todabhim District Karauli Raj (At Present Confined In Central Jail Sewar District Bharatpur) ---Accused-Appellant Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Appellant(s) : Mr. Vinod Kumar Sharma For Respondent(s) : Mr. Rajesh Choudhary, GA-cum-AAG HON'BLE MR. JUSTICE ANAND SHARMA (V. J.) Order 13/06/2025 Heard learned counsel for the parties on the application filed for suspension of sentence and perused the entire material on record. Learned counsel for the appellant would submit that by giving perverse and irrational findings and without examining the evidence in the proceedings, the trial Court has convicted the appellant by judgement dated 30.05.2025 in Sessions Case No. 20/2017 Whereby, after conviction, sentence of five years imprisonment has been imposed upon the appellant. Learned counsel further submits that he was on bail during trial and there is no likelihood of his conviction during pendency of trial. [2025:RJ-JP:23220] (2 of 2) [ SOSA NO.1157/2025 In CRLAS- 1551/2025] Issue notice. Notice is accepted by learned Public Prosecutor. Learned Public Prosecutor has vehemently opposed the prayer regarding suspension of sentence. I have considered the submissions made by learned counsel for the parties. Without commenting upon the merits/demerits of the case and considering the arguments advanced by the parties, this Court deems it just and proper to suspend the sentence awarded to the applicant. Accordingly, the application for suspension of sentence is allowed and it is ordered that sentence awarded by the learned trial Court to the accused-applicant Sitaram Alias Lala S/o Nahar Singh in Sessions Case No.20/2017 shall remain suspended during pendency of the appeal provided he furnishes a personal bond in the sum of Rs.1,00,000/- alongwith two sureties in the like amount to the satisfaction of the learned Trial Court with the stipulation that he shall appear before this Court as and when called upon to do so.
