PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/accused, seeking bail, in Crime No.71/2025 of Gannavaram U.P.S., Krishna District. 2 2. A case has been registered against the petitioner for the offences under Sections 64(2)(m), 65(1) of B.N.S and Section 6 of POCSO Act 2012. 3. Case of the prosecution, in brief, is that, the accused is having live-in relationship with the mother of the victim girl. The victim girl is aged about 14 years and is studying 9th class at Arugolanu village by staying in a hostel. During April, 2024 summer holidays, when the victim girl came to the house, the accused forcibly committed rape on her and threatened her not to reveal the same to anyone. The accused repeatedly committed rape on the victim at her house and on the way at desolated places while bringing her from the school hostel to house. Similarly, on 19.02.2025 at 7.00 pm, in the temporary absence of the informant, the accused while bringing the victim girl in a car from the hostel to the house, on the way took her to isolated place and committed rape on her forcibly. In this connection, the above said crime was registered and investigated into. During the course of investigation, police arrested the accused on 24.02.2025. 4. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is going on and some more witnesses are to be examined and prays to dismiss the Criminal Petition. 3 6. A perusal of the material available on record goes to show that serious accusation has been made against the petitioner herein. The petitioner is in live-in relationship with the mother of the victim. Thereafter, under the pretext of dropping the minor victim girl to the school, he forcibly committed rape on her and threatened her not to reveal the same to anybody. Thereafter also under the threat, he repeatedly committed sexual assault on the minor victim girl. Serious accusation has been made against the petitioner. In view of the same, this Court is not inclined to grant bail to the petitioner. 7. Accordingly, the Criminal Petition is dismissed. _______________________ K.
