Neutral Citation No. - 2025:AHC:27920 Court No. - 32 Case :- WRIT - C No. - 4057 of 2024 Petitioner :- Krishnam Bagri (Minor) Respondent :- Union Of India And Another Counsel for Petitioner :- Agresh Agrawal,Varad Nath Counsel for Respondent :- A.S.G.I.,Ashok Kumar Dwivedi,Deepankar Dwivedi,Hridai Narain Pandey Hon'ble Saral Srivastava,J.
1. Heard learned counsel for the petitioner and Sri H.N. Pandey,
learned counsel for the respondents.
2. The petitioner by means of the present writ petition has prayed for the following relief:-
"i. To issue a writ, order or direction in the nature of mandamus to direct the Respondent no.2, i.e. C.B.S.E. Board, Allahabad through its Secretary/Registrar to endorse correction in the date of birth in the High School/Intermediate Mark-Sheet/Certificate issued on 12.05.2023 by the Respondent No.2. ii. To issue any writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice. iii. To award the costs."
3. At the very outset, Sri H.N. Pandey, learned counsel for the respondents submits that there is concealment of some material fact in the writ petition inasmuch as petitioner had instituted an Original Suit No.141 of 2020 for the same same relief which has been claimed in the present petition, and the said suit has already been dismissed by judgement and decree dated 20.12.2022, copy of which is enclosed as Annexure-5 to the counter affidavit.
4. Since, the petitioner has already instituted an Original Suit for the same relief, which has been dismissed, and the said fact has not
been disclosed by the petitioner in the present petition, therefore, it is a case of concealment of material fact while filing the writ petition.
5. In such view of the fact, the writ petition lacks merit and is accordingly, dismissed with no order as to costs.
