JUSTICE PARTHIVJYOTI SAIKIA ORDER 06.02.2025 Heard Mr. P K Roychoudhury, learned counsel for the petitioners and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 by the petitioners, namely, (1) Sifat Ali Barbhuiya; (2) Abul Hasan Barbhuiya @ Hasan Ahmed; (3) Hussain Ahmed Barbhuiya; (4) Rahim Uddin Barbhuiya; (5) Moynul Hoque Barbhuiya @ Masuk Ahmed Barbhuiya; (6) Abdul Hannan Barbhuiya @ Hanna Uddin Barbhuiya; (7) Kaidul Hussain Laskar; (8) Ansar Uddin Barbhuiya; (9) Sariful Nessa Laskar; and (10) Sorgul Nessa Barbhuiya, praying for pre- arrest bail in connection with Hailakandi P.S. Case No. 276/2024. Two neighbouring families had a quarrel on the issue of land dispute. It is alleged that, in the said incident, the petitioner nos. 7 and 8 had attacked one Ms. Alfatun Nessa Barbhuiya. Because of the said attack, she sustained serious injuries and subsequently, she succumbed to her injuries. The case diary shows that the other petitioners also took part in the said quarrel. I have considered the submission made by the learned counsel for both sides. The parties are already involved in a land dispute. Because more than 1 (one) month ago, the petitioners also filed an FIR against the informant of this case. The present petitioners except petitioner nos. 7 and 8 have assisted the Police Investigating Officer in the investigation of the case and for that reason, this court is of the opinion that they do not deserve to be detained in custody. Accordingly, the interim bail granted in favour of the petitioners by this court vide order dated 07.01.2025 except the petitioner nos. 7 and 8 is made absolute. Page No.# 4/4 However, the pre-arrest bail prayer of the petitioner nos. (7) Kaidul Hussain Laskar; (8) Ansar Uddin Barbhuiya is rejected. The petitioners except the petitioner nos. 7 and 8 shall cooperate with the investigation as and when called for. The bail application is disposed of. Case Diary shall be returned.
