Learned counsel Mr. A. Mannaf is present for the petitioner 'X' who has filed this application under Section 397 read with Section 401 of the Cr.PC challenging the judgment and order dated 03.10.2023 passed by the learned Additional Chief Judicial Magistrate, Karimganz in connection with Misc. Case No. 118(A)/2020 directing the respondent No. 1/'Y' to pay monthly maintenance of Rs. 2,000/- to the petitioner along with monthly maintenance of Rs. 1,000/- for the minor daughter. 2. Learned counsel Mr. N. H. Barbhuiyan is present for the respondent and learned Additional Public Prosecutor Ms. S. H. Bora is present for the respondent State. 3. It is submitted at the Bar that both the parties are willing to amicably settle the dispute. It is submitted that the respondent has paid Rs. 3,00,000/- as full and final payment between both the parties. 4. The petitioner is not willing to proceed against the respondent. The petitioner has no further demand for monthly maintenance to be paid by the respondent. 5. It is submitted on behalf of the petitioner that the petitioner is also not willing to proceed with the original case i.e. Misc Case No. 118(A)/2020 as she has received Rs. 3,00,000/- as one time maintenance. 6. It is further submitted that both the parties are to approach the learned Trial Court to submit on a petition filed for compromise. Page No.# 3/3 7.
