Heard learned counsel for the petitioners, Sri Deena Nath on behalf of respondent no. 3 and learned AGA for the State. 2. The present writ petition has been filed praying for quashing the First Information Report dated 6.2.2025, registered as Case Crime No. 73 of 2025, under Sections 115(2), 352, 351(2), 333 of BNS and Section 3(2) (va) of SC/ST Act, Police Station - Sarai Khwaja, District - Jaunpur. It is further prayed that respondents be restrained from arresting the petitioners pursuant to the aforesaid FIR. 3. Learned counsel for the petitioners submits that with regard to allegations made in the FIR, a civil dispute is already pending between the parties before the competent court. The police is investigating the allegations made in the FIR. 4. Learned AGA has opposed the submissions made by learned counsel for the petitioner. 5. For the reasons given in the order dated 10.7.2024 passed in Criminal Misc. Writ Petition No.7463 of 2024, this writ petition is disposed of directing that till submission of police report under Section 173(2) Cr.P.C./193(3)BNSS, the respondents are restrained from arresting the petitioner pursuant to the impugned First Information Report, subject to cooperation in ongoing investigation.
