Gautam Sharma, learned counsel appearing for the applicant and Mr. Samarjit Hawaibam, learned Sr. counsel appearing for the respondent. Learned counsel for the State respondent submits that the ground for delay is not proper and not reasonably explained and further submits that the calculation of the delay made by the appellant has excluded 47 days from the total number of delays. It should be 893 days (i.e. 846 days + 47 days = 893 days) not the calculated 846 days. Gone through the application with the ground stated thereby in the application and the objection filed by the respondents. While doing so, the applicant’s reason and ground made in the application is reasonable enough to allow the application as this is satisfied with the ground and reasons made in the application. The delay of 893 days (846 days + 47 days) including 47 days as pointed out by the State respondent is condoned and allowed. Accordingly, this MC(Crl. A) No. 36 of 2024 is disposed of. Registry is directed to number the appeal.
