02/ 04.02.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Rikhiya P.S. Case No. 163 of 2025, registered under sections 126(2), 115(2), 109(1), 61 of B.N.S Act and under section 27 of the Arms Act, pending in the Court of learned Judicial Magistrate, Ist Class, Deoghar.

Learned counsel for the petitioner submits that there are general and omnibus allegation against all the accused persons. He further submits that petitioner and informant are agnates. He next submits that only allegation against the petitioner has been made that he has threatened the husband of the informant on 09.09.2025 and F.I.R has been registered on
24.09.2025. He next submits that allegation of firing is against co-accused Birendra Burnwal pursuant to that husband of the informant has received injury. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there against the petitioner of threatening.

From the contents of F.I.R, it transpires that allegations against the petitioner are made that on 09.09.2025 the petitioner has threatened the

husband of the informant and allegation of firing is there against Birendra Burnwal.
6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Deoghar, in connection with Rikhiya P.S. Case No. 163 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
