ORDER : The Court made the following order :- The petitioners/sole accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 331(4) and 305(a) of BNS, 2023 in Crime No.507 of 2025 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the defacto complainant gave her jewels to her sister-in-law and daughter-in-law to keep the same in the bureau. The next day, when the defacto complainant checked the bureau, the jewels were missing and a sum of Rs.2,800/- also missing. It is further alleged that the jewels were pledged by the accused. Hence, the complaint.
3. This Court granted interim anticipatory bail to the petitioner and
directed the petitioner to appear before the respondent police and cooperate for investigation. 2/5 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.12343 of 2025 4.Today, it is reported that the petitioner has complied with the condition and cooperated for the investigation. After investigation, the respondent police have come to the conclusion that the petitioner cannot be included as an accused since the jewel which were pledged by the petitioner and the alleged jewels are different. As of now, the prosecution is not included the petitioner as accused.
5. Recording the same, this Criminal Original Petition is closed. If the petitioner is included in the crime in future, he is at liberty to work out his remedy in the manner known to law.
