JUSTICE PARTHIVJYOTI SAIKIA ORDER 06.02.2025 Heard Mr. H R A Choudhury, learned senior counsel for the petitioner, assisted by Mr. M I Hussain, Advocate and Mr. R R Kaushik, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 by the petitioner, namely, Atikur Rahman Sikder @ Khokon praying for pre-arrest bail in connection with Lakhipur P.S. Case No. 268/2024. The informant has alleged in the FIR that on 03.11.2024 the accused had assaulted the son of the informant causing serious injuries. The Medical Report and the Case Diary shows that the injured person sustained simple injuries. I have considered the submission made by the learned counsel for both sides. Since the injured sustained simple injuries only, the petitioner Atikur Rahman Sikder @ Khokon does not deserve to be detained in custody. Hence, the prayer for pre-arrest bail of the petitioner is allowed. Accordingly, the interim order dated 04.12.2024 granted in favour of the petitioner is made absolute.
