The instant interlocutory application is preferred by the applicant who is the petitioner in the accompanying contempt case, Cont.Case[C] no. 791/2023, seeking impleadment of the incumbent presenting holding the post of Commissioner, Panchayat and Rural Development Department, Assam. 3. The accompanying contempt petition, Cont.Case[C] no. 791/2023 is preferred alleging non-compliance of the direction made in an Order dated 14.12.2022 passed in a writ petition, W.P.[C] no. 8019/2022. By the Order dated 14.12.2022, the Commissioner, Panchayat and Rural Development Department, Assam has been directed to pass a reasoned order on the representation of the petitioner. 4. It is averred that at the time of preferring the contempt petition, the opposite party no. 1 was holding the office of Commissioner, Panchayat and Rural Development Department, Assam. But subsequently, after transfer of the opposite party from the said office, the proposed opposite party no. 2, that is, ‘Keerthi Jalli, IAS, Commissioner, Panchayat and Rural Development Department, Panjabari, Juripar Road, Dispur, Guwahati-781037, Assam’ has joined in the said post. In such view of the matter, the proposed opposite party is to be impleaded as a party-respondent no. 2. 5. The fact that the proposed opposite party no. 2 is holding the office of the Commissioner, Panchayat and Rural Development Department, Assam is endorsed by Mr. Dutta, learned counsel appearing for the opposite party no. 1. 6. In view of the above fact situation, the instant interlocutory application is allowed. 7. The learned counsel for the applicant-petitioner shall file an amended Page No.# 3/3 Cause-Title in terms of the Notification no. 79 dated 19.06.2023 within 2 [two] working days and on submission of the amended Cause-Title, the Registry to carry out the necessary corrections in the accompanying contempt petition as well as in the CIS and list the accompanying contempt petition after a week.
