Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of B.N.S.S., 2023 seeking transfer of Special Session Case No.47 of 2018, titled State Vs. Ramzan Ali and others, arising out of case crime no.1582 of 2017, under Section 2/3 U.P. Gangster Act, Police Station Sindhauli, District Shahjahanpur, pending in the court of Special Judge (Gangster Act)/Additional Session Judge, court no.5, Shahjahanpur to the nearest district. Learned counsel for the applicant submits that the prosecution has examined nine witnesses out of total twenty four and the trial is not making any headway, therefore, the applicant- accused is seeking transfer of the case. During the course of hearing, it is not disputed that the applicant is on bail and the other accused persons have not been impleaded. Merely because there is some delay in conclusion of trial, that cannot be construed as a valid ground for transfer of the case. This application is dismissed.
