JUSTICE HASMUKH D. SUTHAR Date : 10/06/2025 ORAL ORDER RULE. Learned APP waives service of notice of Rule for and on behalf of the respondent – State of Gujarat. After arguing for some time, when this Court is not inclined to entertain the present petition, learned advocate for the petitioner, upon instructions, seeks permission to withdraw the present petition. However, learned advocate for the petitioner has drawn attention qua judgment dated 08.12.2015 passed by the coordinate Bench in Special Criminal Application (Possession of Muddamal) No.7108/2015 whereby though specific direction was issued to the learned Additional Chief Judicial Magistrate, Court No.11, Ahmedabad to complete the trial of Criminal Case No.217/2012 and pronounce the judgment on or before 31.05.2016, trial is moving at snail’s pace. Considering the above fact, present petition is disposed of R/SCR.A/3577/2025 ORDER DATED: 10/06/2025 with direction to the learned Additional Chief Judicial Magistrate, Court No.11, Ahmedabad to expedite the trial of Criminal Case No.217/2012 and scrupulously follow the direction issued by the coordinate Bench in SCR.A (Possession of Muddamal) No.7108/2015 in judgment dated 08.12.2015. Even the accused persons are directed to cooperate the learned Magistrate in expeditious trial of the criminal case. Rule is hereby discharged.
