Court No. - 87 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 16162 of 2023 Applicant :- Sone Lal Opposite Party :- State of U.P. Counsel for Applicant :- Azaz Ahmad,Puneet Kumar Counsel for Opposite Party :- G.A.,Ganesh Shankar Dubey Hon'ble Anil Kumar-X,J. 1. Heard Sri Manvendra Singh, learned counsel for the applicant, Sri Ganesh Shankar Dubey, learned counsel for informant and the learned Additional Government Advocate for the State. 2. The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No.301 of 2022, under Section 498A, 323, 504 and 506 of IPC, at Police Station Khaga, District Fatehpur during the pendency of trial. 3. It is argued by learned counsel for the applicant that as per allegations of the FIR, deceased Geeta Devi was married with the present applicant- Sone Lal on 16.4.2015 and was tortured by her husband and in-laws as she was unable to bear child after marriage. It is also alleged that the present applicant developed illicit relationship with some another woman and when it was opposed by Geeta Devi, she was beaten by the applicant and her parent. Geeta Devi committed suicide on 11.7.2022 due to harassment meted out to her by the present applicant and her in- laws. It is further argued by learned counsel for the applicant that he has been falsely implicated in the present case and the victim was in depression and when she was unable to bear this depression she has committed suicide. Learned counsel submits that there is no prospect of trial of the present case being concluded in near future due to heavy dockets. The applicant is languishing in jail since 12.10.2022 and in case, he is enlarged on bail, he will not misuse the liberty of bail. Learned counsel for the informant has opposed the bail prayer of the applicant by contending that the postmortem of the deceased reveals six injuries on her person. The applicant have not come forward with any explanation to six ante- mortem injuries. 4. The Trial in this case has commenced and two prosecution witnesses have been examined. Both the prosecution witnesses have supported the version of the FIR. Keeping in view the injuries sustained by the deceased and the offence committed by the applicant, who is husband of the deceased, the bail application of the applicant is liable to be rejected. 5. Per contra, learned Additional Government Advocate has opposed the bail prayer of the applicant by contending that the applicant will misuse the bail by extending threat and intimidation to the prosecution witnesses. 6. Having considered the submissions of the parties, without expressing any opinion on the merits, the bail application is allowed. 7. The doctor who has conducted the postmortem has recorded the ante-mortem injuries sustained by the deceased, there are five ante-mortem injuries on the body of the deceased. The injuries are simple in nature and it is difficult to hold at this stage that six injuries were caused by the present applicant or his family members. The applicant is in jail since 12.10.2025. 8. Let the applicant- Sone Lal, involved in the aforesaid case be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :- (i). The applicant shall not tamper with the prosecution evidence by intimidating/pressurizing the witnesses, during the investigation or trial. (ii). The applicant shall cooperate in the trial sincerely without seeking any adjournment. (iii). The applicant shall not indulge in any criminal activity or commission of any crime after being released on bail. 9. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
